TERMS AND CONDITIONS
(TÕUKERATAS.ee – PlayArt OÜ)
1. General Provisions
1.1. These terms and conditions (hereinafter „Terms") govern the sale and purchase of goods through the TÕUKERATAS.ee online store (hereinafter „Online Store").
1.2. The online store is managed by PlayArt OÜ (registration code 12163003, VAT EE101480011), address Mustamäe tee 16, 10617 Tallinn, Estonia (hereinafter „Seller").
1.3. By submitting an order, the online store user (hereinafter „Buyer") confirms that they have read and agree to the Terms in full.
1.4. The Terms apply to all sales contracts concluded in the Online Store.
1.5. Sales and contractual communication in the Online Store are conducted in Estonian.

3. Submitting an Order and Contract Conclusion
3.1. The Buyer selects the desired products and adds them to the shopping cart.
3.2. An order is confirmed when the Buyer confirms the purchase and pays for the order.
3.3. The sales contract is considered concluded from the moment the Seller sends the order confirmation to the Buyer via email.
3.4. The Buyer is responsible for the accuracy of the data provided in the order.
3.5. The Seller has the right to cancel the order if: the ordered product is not available; there is an obvious price error or technical mistake; the order contains inaccurate data.
4. Prices and Payment
4.1. All prices are shown in euros and include VAT.
4.2. A shipping fee may be added to the price, which is displayed before confirming the order.
4.3. Payment is made through the payment methods offered in the Online Store (including bank links, card payments, installment services).
4.4. The Seller has the right to cancel the order if payment is not received within 7 calendar days.
5. Product Availability and Delivery
5.1. The estimated delivery time for products in stock is 1–3 working days, unless otherwise indicated on the product page.
5.2. The delivery period begins from the receipt of payment.
5.3. If the product cannot be delivered, the Buyer will be notified and the paid amount will be refunded within 14 days.
6. 14-Day Right of Withdrawal
6.1. The consumer has the right to withdraw from the contract within 14 calendar days from receipt of the goods.
6.2. The returned goods must be unused and in original packaging, unless the packaging is necessary to determine the nature of the goods.
6.3. The Buyer bears the direct costs of return, unless otherwise agreed.
6.4. The Seller will refund the paid amount within 14 days from receipt of the withdrawal notice.
7. Claims and Liability for Defects
7.1. The Seller is liable for non-compliance of the goods with the contract terms, which appears within two (2) years from the delivery of the goods to the consumer.
7.2. In case of a defect appearing within the first year, it is presumed that the defect existed at the time of delivery, unless proven otherwise.
7.3. The defect must be reported within a reasonable time to the email address: info@playart.ee or garantii@playart.ee.
7.4. The Seller has the right to have the defect examined by an independent expert.
7.5. The Seller will remedy the defect, replace the goods or refund the money in accordance with the law.
8. Warranty
8.1. In addition to the statutory liability, the product may have a manufacturer warranty.
8.2. The warranty does not cover: normal wear and tear (wheels, brakes, handles, etc.); improper use; damage from trick or racing riding; unauthorized modifications.
8.3. Aggressive use of electric scooters (tricks, jumps, extreme loads) may result in warranty voidance.
9. Product Use and Liability
9.1. Electric scooters and other sports equipment can be dangerous and their use is at the Buyer own risk.
9.2. The Seller always recommends using protective equipment (helmet, pads).
9.3. The Seller is not liable for injuries caused by improper use of the product or ignoring safety instructions.
10. Intellectual Property
10.1. All texts, images and other content published in the Online Store belong to PlayArt OÜ or rights owners.
10.2. Using the content for commercial purposes without written permission is prohibited.
11. Processing of Personal Data
Processing of personal data is carried out in accordance with the Privacy Policy.
12. Dispute Resolution
12.1. The Seller and Buyer will resolve disputes primarily through negotiations.
12.2. The consumer has the right to contact the Consumer Disputes Commission or the EU online dispute resolution platform: https://ec.europa.eu/odr
12.3. Disputes are resolved under the law of the Republic of Estonia.
13. Amendment of Terms
The Seller has the right to amend the Terms. Amendments will take effect from the date of publication in the Online Store.
